These terms and conditions ("Terms") govern the use of ForthShine's website and the provision of our automation services to letting agents, estate agents, and related businesses ("you", "your", "the client"). By engaging ForthShine ("we", "us", "our") for services, or by using our website, you agree to these Terms.
ForthShine is an independent automation service, trading under the name ForthShine. We are not currently registered as a limited company. References to "ForthShine" throughout these Terms refer to the individual(s) trading under this name.
We design, build and maintain automated workflows for letting and estate agencies, using n8n and related tools, connected to your existing systems (such as CRMs, calendars and property portals). Services typically include, depending on the package agreed: instant enquiry response, viewing reminders and no-show recovery, tenancy renewal tracking, rent arrears escalation sequences, compliance certificate monitoring, buyer follow-up, and seller pipeline updates.
The exact scope of work is agreed with you individually before any build begins, following a consultation call.
Engagements typically begin with a free consultation, followed by a scoping and onboarding call, a build and testing phase, and a go-live date. Timescales are estimates and may vary depending on the complexity of your requirements and the responsiveness of any third-party systems we need to connect to.
Pricing is tailored to the size of your agency and the scope of automation required, and is confirmed in writing before any work begins. No fees are charged, and no obligation is created, until you have agreed a quote with us. Payment terms will be set out in your individual quote or agreement.
We do not lock clients into long-term contracts. After the first month of an ongoing service, you may cancel by giving 30 days' written notice by email. Any setup or build fees already paid for work carried out are non-refundable, unless otherwise agreed in writing.

Delays caused by late access, incomplete information, or slow responses on your side may affect our ability to meet agreed timescales.
Once fully paid for, the specific automation workflows, connections and documentation we build for you belong to you. We retain ownership of our general methods, templates, and any pre-existing tools or frameworks used to deliver the service, which are not transferred as part of any engagement.
Where the automations we build process personal data on your behalf (for example, tenant or buyer contact details), you remain the data controller for that information and ForthShine acts as a data processor, processing it only on your documented instructions. See our Privacy Policy for further detail. If you require a formal Data Processing Agreement, please request one before work begins.
Our automations rely on third-party platforms and services (such as n8n, hosting providers, email, SMS or WhatsApp providers, and the property portals or CRMs you use). We are not responsible for outages, changes, or limitations imposed by these third parties, though we will make reasonable efforts to notify you of any issues and adjust the automation where possible.
We provide our services with reasonable skill and care, but we do not guarantee uninterrupted operation of any automation, given its reliance on third-party systems outside our control. To the fullest extent permitted by law, our liability for any loss or damage arising from our services is limited to the fees paid by you for the specific service giving rise to the claim. We do not exclude or limit liability for death or personal injury caused by negligence, or for fraud, or for any other liability that cannot legally be excluded.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of our services after changes are published constitutes acceptance of the updated Terms.
